Samsung Galaxy S Duos makes the rounds, bring GS3 vibe to dualSIM world

Fans of Samsung's Duos phones wanting 2012 updates have had to make do with last year's looks so far. From what's surfacing through multiple Indian sites, though, Samsung must want to spread some of the Galaxy S III's modern, nature-influenced style to the Duos' twin-SIM audience. The Galaxy S Duos S7562 won't make its bigger sibling jealous with a 4-inch WVGA display, a 1GHz Snapdragon MSM7227A chip or 512MB of RAM, but they're not the point. As always, the highlight is that pair of SIM slots for carrying both home and work phone lines -- or simply mixing and matching prepaid plans. The rest of the hardware falls in line with what's likely to be a much less expensive smartphone, including a 5-megapixel back camera, a VGA front camera and 4GB of storage. Buyers will be glad to know that Android 4.0 should still be coming along for the ride in addition to that stone-inspired look. We've asked Samsung for more official details; there's talk of an Indian launch before the end of the summer, which (if true) could give the crowds in Bangalore and Mumbai more to look forward to in the fall than just cooler temperatures.

Gov't bars Fannie-Freddie from reducing principal

(AP) ? A federal regulator is standing by its decision to bar Fannie Mae and Freddie Mac from reducing principal for borrowers at risk of foreclosure, resisting pressure from the Obama administration.

The Federal Housing Finance Agency announced the decision Tuesday after months of considering the option.

The agency's acting director, Edward DeMarco, has long opposed allowing Fannie and Freddie to offer principal reduction.

DeMarco said an extensive analysis by the FHFA found the potential benefit was too small compared with the costs and risks. The risks include as many as 19,000 borrowers strategically defaulting on their loans, according to the analysis.

About 74,000 to 248,000 homeowners would be eligible for principal reductions from Fannie and Freddie, the analysis showed. An estimated 11 million Americans owe more on their mortgages than their homes are worth.

The Obama administration immediately voiced its disappointment with the decision.

"I do not believe it is the best decision for the country," Treasury Secretary Timothy Geithner said in a letter to DeMarco.

Geithner said allowing Fannie and Freddie to do "targeted" reductions of principal for troubled borrowers would provide much-needed help to a significant number of troubled homeowners. He said that would help repair the nation's housing market and result in a net benefit to taxpayers.

The government rescued Fannie and Freddie in September 2008 to cover losses on soured mortgage loans. Since then the FHFA, which is independent of the administration, has controlled their financial decisions.

U.S. taxpayers have spent roughly $170 billion to rescue the companies. It could cost roughly $260 billion more to support them through 2014 after subtracting dividend payments, according to the government.

The Treasury Department said in January that it would cover part of the cost if Fannie and Freddie could reduce principal when they modify mortgages for troubled borrowers. The department said it would use unspent housing rescue money from the $700 billion Troubled Asset Relief Program, or TARP.

DeMarco acknowledged in a meeting with reporters that administration officials and others could disagree with the agency's decision and interpret its analysis differently.

"Others could look at this and weigh these things differently," he said.

Gay and Lesbian Friendly Yellow Pages Directory ? GayFriendlyBiz ...

In the first graduating class at Milwaukee?s Alliance High School, the valedictorian ? the year?s most distinguished student ? scored a D+. ?They were smart,? recalls Tina Owen, the school?s founder and lead teacher. ?But a lot of them had not been going to school because they were being bullied, and a lot of them had problems at home. That year we had 15 kids. Five of them had lived with me at some point during the year, for one reason or another.?

Alliance is not a regular school. Its aim is to cater to a community that is at?best ignored and, at worst, is actively denied its existence ? lesbian and gay youth. Call it a gay school and you will be promptly corrected. There?s no entrance criteria on the grounds of sexual orientation or anything else. The school building, an unassuming brick block set back from a main road, doesn?t fly rainbow flags or emblazon its walls with posters of pink triangles. Owen guesses about half the students are LGBT (Lesbian, Gay, Bisexual or Transgender). ?If you are gay, no big deal,? she?says. ?If you aren?t, no big deal.?

But the school, which is funded by the state of Wisconsin, is self-avowedly gay-friendly. ?Here they can talk about a?relationship or a break-up without worrying about how that?s going to be received,? explains Owen. The posts of Prom King and Prom Queen are open for anyone to run for, regardless of their gender. A mural at its entrance bears the words ?knowledge, respect, peace?, and a sign saying Stonewall Inn. It?s a small school ? just 165 students ? where everybody knows each other. The corridors host more than the regular share of boys with shoulder-length hair or painted nails. All together it adds up to a critical mass of children who say they felt they didn?t fit in elsewhere ? whether they are goths, punks or nerds ? which makes being a non-conformist at Alliance the norm. The school?s art teacher affectionately described the school to Time magazine as ?the island of misfit toys?.

At a time when sexual diversity has never been more accepted in the US, the?emergence of such schools ? there are a few around the country ? seems paradoxical. ?What does it say about our country that we have schools like this?? asks Ritch Savin-Williams, a professor of?developmental psychology at Cornell university, and author of The New Gay Teenager. They have come under fire from social conservatives, religious groups and some in the gay community.

Owen admits it is not to everyone?s liking. One boy called home after his first few days there and said: ?Dad, get me out of here, these kids are freaks.?

But to others it?s literally a lifesaver. Dylan Huegerich?s long hair and occasional use of makeup made him the?subject of frequent taunts in school in the small town of Saukville where he grew up. ?It hurt so bad,? he said. ?I?hated my life. I hated everything. When his mother complained to the school she was told he should cut his hair and try to act ?more manly?. Every morning, she told Time, ?I knew I was driving him back to this place where he?was hurting. Oh, they beat you up? Here, go there again. My heart broke every time he got out of the car.?

She decided not to enroll him for eighth grade. ?I felt like if I turned in those forms, I was giving him some kind of a sentence.? So he went to Alliance, a?90-minute commute away.

The school, founded in 2005, was modeled on Manhattan?s Harvey Milk High School, which was named after the late San Fransisco gay activist whose story was the basis for the award-winning film Milk, and which became fully accredited in 2002. It started as a high school (ages 14-18), expanded to include middle school-age children (11-14) as well, and is now about to revert to being just a high school again.

Michael Freytes, 17, who is straight, says he likes Alliance because he doesn?t feel judged. ?When I was in middle school I was being bullied a lot. I tried to?fit in but I couldn?t. But if there?s a problem like that at Alliance the other students don?t tolerate it and the teachers take care of it.? The students resolve conflict through what they call ?restorative justice?, though a ?justice circle?, governed by students, which Freytes says ?tries to figure out the problem and then fix it without things getting out of control?.

The primary justification for the existence of schools such as Alliance is safety ? an institutional response to the pervasive bullying experienced by LGBT youth and others in mainstream schools.

The problem seems severe. A 2009 survey conducted by the Gay, Lesbian and Straight Education Network (GLSEN) revealed that 9 out of 10 LGBT students said they had experienced harassment or bullying. Almost two-thirds claimed they felt unsafe in school, while one in five said they had been physically assaulted. A 2007 survey revealed that 39% reported physical assaults and, of those who told teachers or administrators about the bullying, only 29% said it?resulted in effective intervention. The?2009 survey also found that the frequency with which LGBT students experienced more severe forms of bullying and harassment had held steady over the previous decade.

Last winter, 14-year-old Kenneth Weishuhn killed himself after he came out at his Iowa high school. Anonymous threats on his voicemail were followed by yelling and physical harassment that got so bad teachers had to stand guard in the hallways. Kenneth eventually hung himself in his parents? garage.

Even when parents aren?t prepared to accept their children are gay, says Owen, they understand the need to put their child in a nurturing environment. ?They?want their kid to be safe. They want to know that their child is not going to be spat on or kicked just because of who they are.?

Attitudes towards homosexuality are?changing radically in the US, even in midwestern states such as Wisconsin, and even if every time gay marriage has been put to the vote at a state level, it has failed. President Obama recently came out in favour of gay marriage, which is legal in six states and Washington DC, covering 12% of the country. According to Gallup, today almost two-thirds of people in the US believe lesbian and gay relationships should be legal, compared with fewer than half in 1977.

Today more than half (54%) believe?homosexuality is morally acceptable, compared with 40% in 1977.?And the people most likely to be?comfortable with homosexuality as a?fact of life that?should enjoy equal rights?and protection are the young.

Predictably, social conservatives are not enamoured with this trend or this educational response. The chairman of?the Conservative party of New York?State, Michael Long, said the establishment of the Harvey Milk School?amounted to social engineering. ?Is?there a different way to teach homosexuals? Is there gay math? This is?wrong ? there?s no reason these children should be treated separately.?

Nonetheless, they are often treated differently, and Chad Weiden, who led efforts to set up a gay-friendly school in Chicago, says that part of the skill in teaching is making sometimes abstract issues accessible to students. ?It?s all about making it relevant to kids. If you?re doing probability in math, you could illustrate it by looking at GLBT suicides or stop-and-frisk or unemployment. A good curriculum would also deal with issues of sexual orientation when covering things like evolution, biodiversity, anthropology, history and literature. That should be true of any school, not just one that considers itself?gay-friendly.?

But behind these conservative attacks?lie two broader motivations. The?first, underpinned by the notion that homosexuality is wrong, is that any mention of homosexuality ?normalises? gay identity, and might encourage impressionable young people to become gay who otherwise wouldn?t.

?What about that girl who is a virgin, who is being harassed by lesbians and guys to have sex, and yet you?re going to?build a gay school?? a Chicago minister, Wilfredo de Jesus, asked the Chicago Journal. ?It?s not fair.?

Such accusations, says Savin-Williams, are absurd. ?There is absolutely no evidence that gay or straight kids can be created in that way, let alone converted. It?s a nonsense.?

Some would rather that gay youth were neither seen nor heard. A network of gay-straight alliance clubs have sprung up in schools around the US, to provide peer-group support for lesbian and gay students. But their emergence has often been challenged by school authorities and conservative parents, forcing students to the courts to?defend their right to self-organise, as happened last year in West Bend, Wisconsin, just 45 minutes? drive from Alliance.

The right calls efforts to recognise sexual diversity ?pushing a gay agenda?. When Weiden was trying to set up his school, conservatives tried to provoke them into saying they would promote gay lifestyles. ?They were just goading us. ?Say it, say it, will you teach gay lifestyles.? I could have said: ?I?m gay, the kids are going to be gay, it?s going to be the biggest flaming school in the city.? But we were just not going to say that.?

The second motivation, however, is steeped in a far more pervasive belief that gay teens and pre-teens are simply not in a position to fully understand and label their sexual orientation: that like being a goth, punk or nerd, it might just be a phase they were going through. This partly resides in the anxiety most parents have about their adolescent children?s burgeoning sexuality.

But it is also a function of associating an awareness of being gay with being sexually active, and holding gay identity to a different standard to heterosexuals. A 12-year-old boy expressing a furtive interest in girls or vice versa would provoke little concern. Indeed, the issue of his straightness wouldn?t even come up. A 12-year-old boy who finds himself attracted to other boys, however, would not have that luxury. Since sexual identity is fluid there is, of course, the?possibility that preferences may change.?But that is no less true for the straight boy than the gay one. And, the?chances?are that, whichever gender?they?are attracted to, both may well still?be waiting for their first kiss.

?No one says to [a straight teen or pre-teen boy]: ?Are you sure? You?re too?young to know if you like girls. It?s probably just a phase,?? Eileen Ross, a director of the Outlet Program, a support service for gay youth in California told the New York Times. ?But that?s what we say too often to gay youth. We?deny them their feelings and truth in?a way we would never do with a heterosexual young person.?

In previous generations young people would wait until college to come out. Now they feel sufficiently emboldened to come out in middle or high school ? at?an age and in a place characterised by?teasing, bullying, sexual exploration and hormonal turbulence. ?Kids are definitely coming out earlier, and middle school is definitely the worst time for bullying, whether you?re straight or gay,? says Savin-Williams. There are several summer camps around the country, that cater to?transgender children as young as eight.

?We always knew middle school was a time when kids struggle with their identity,? one middle-school counsellor told the New York Times, confessing that her school was ?totally unprepared? for openly gay students, ?but it was easy to let anti-gay language slide because it?s so imbedded in middle-school culture, and because we didn?t have students who were out to us or their classmates. Now we do, so we?re playing catch up to?try to keep them safe.?

But gay-friendly schools have also met resistance from members of the gay?community who believe that such schools amount to segregation, simply sheltering gay youth from the realities of homophobia while letting mainstream schools off the hook.

Savin-Williams is skeptical about the purpose of gay-friendly schools. ?Most of the kids who are at these schools are there not so much because they are gay, but because they are very gender atypical [not conforming to traditional stereotypes]. That?s not most gay kids. Where does it stop? Do you have a school for fat?kids and annoying kids and all the others who just don?t fit in??

They thought it was segregation. ?If you create this school,? they said, ?then you don?t make other schools accountable.? But kids are scared now. They?re hurting now. Making the schools accountable will take years. I hope that?in 10 years you wouldn?t need our school anymore. But?they need it now.?

Owen agrees. ?As much as it should be being addressed in other schools, the?fact is that it isn?t,? she says. ?And?it?s not as though our students were unaware of what was out there. That?s why they?re here. They say: ?We do the world everyday. We know what the world is like.? And the reality is that the world outside high school is much more like this. It?s much more gay-friendly than high schools are.?

More than half of lesbian, gay and bisexual young people have experienced homophobic bullying at?school in the UK, according to a survey published by Stonewall earlier this month. Almost all of the 1,600 young people questioned said homophobic name-calling is common, a finding backed up by a recent Ofsted report that found widespread use of?the word ?gay? as an insult.

Wes Streeting, Stonewall?s head of?education, said: ?We?ve found that?homophobic bullying is lower in?schools that explicitly state homophobic bullying is wrong and where incidents are dealt with swiftly?and seriously. The best schools are those that go beyond tackling bullying by celebrating difference and?addressing gay issues in a positive?way across the curriculum.?

At one primary school that successfully countered bullying, Ofsted?inspectors said pupils were?comfortable about rejecting stereotypes ? a six-year-old boy wore a tutu without comment from classmates, while a girl wrote a fairy story that ended with the marriage of two princesses. Children in Year Six learned about gay role models such as the actor Ian McKellen and the?rugby player Gareth Thomas (pictured).

At another school where many pupils had?anti-gay attitudes ? children frequently used terms such as ?batty man? and ?queer? ? the headteacher used the curriculum to explore gay?topics; studying Alan Turing?s life in technology lessons and the Nazi persecution of homosexuals in?history. The school brought?in external role models including a black lesbian rapper and a gay Muslim?group.

Apple accused of infringing upon a Taiwanese university's patents with Siri personal assistant

A university in Taiwan has sued Apple for allegedly infringing upon the school's patents with the Siri virtual assistant found in the iPhone 4S and soon the iPad. The National Cheng Kung University (NCKU) says that all of Apple's devices with "voice activated assistant capabilities" infringe upon its patents. Apparently, the lawsuit is in retaliation for Apple's legal actions against HTC in the U.S., which is a Taiwanese company. The NCKU filed its lawsuit in Texas because of its favorable climate for patent owners, though the school is not saying how much it wants in compensation from Apple at this time.

Good financial management is all about good change management ...

?

In my line of work, I live with change every day.? Actually, it?s part of my job title.

When I think about my own financial journey, my objectives to achieve financial freedom, I see many parallels between good financial management and good change management principles. ?Let me share with you what I mean, including an 8-step recipe I?ve adapted by a change management guru to help you and I both get better at it.

In the business world, from an organizational perspective, employees should not be burdened with the responsibility to manage change.? Instead, it is the employee?s responsibility to do their best ? whereby ?best? is different for every person and ?best? depends on an array of factors (such as mental and physical health, maturity, experience, motivation, etc). ?In the business world, in organizations, the responsibility to manage change rests with management ? management must manage change in a way so?employees can understand it and?execute on it.? Management has a responsibility to facilitate change by creating an environment to think about change in a positive manner; help employees understand it so employees can ultimately get behind it.? Whether most managers realize it or not, management?s main role is not to manage the work but to manage the people doing the work,?focusing employees to see, think, believe, feel and act on?change differently.??Effective and efficient change management practices are?key to?long-term business success.

If change management is such a critical factor in organizational success, is it surprising to understand why financial management is so challenging for many households?

Without a household ?management team? focused on managing change, financial change more specifically, many households are doomed -?ultimately there is no change.? Without a household management team there?is?no catalyst for change.??In my opinion households are like very small organizations ? they too need to be managed ? and on the financial front they?need to apply some change management principles to be successful.

Why are some households more successful than others?? Consider some of the excuses first:

  • They have more income.
  • They get good breaks.
  • They had a better upbringing.

While more income, more luck and a good start in life are certainly enablers for financial success they don?t mean it will happen.? So, regardless if you live in a household of one or many people consider some of the following steps to become better at financial management, some tailoring from John Kotter?s 8-steps for organizational change management in bold font:

Increase urgency ? make problems and the need to solve them real.

Build the guiding team ? get you and/or your spouse talking about finances, get an emotional commitment.?

Get the vision right ? get you and/or your spouse focused on a simple vision.? Make $50 in extra mortgage payments each month.

Communicate for buy-in ? involve others.? Share your approach and your vision with others.? Get some feedback.? ??

Empower action ? identify your obstacles then empower yourself to act.? Good thoughts and good actions don?t produce bad results.

Create short-term wins ? set aside some items that are easy to achieve.? One example could be to save $50 every month in a savings account.? Start slow, start small and learn to do one thing really well before starting something else. ?

Don?t let up ? monitor your progress, mark milestones on the fridge, your smartphone or wherever progress is highly visible.? ?

Make change stick ? weave it into your daily life; reinforce the success you had this month, this week or even today and share it with others.

I?think good financial management is really all about good change management.? I suspect the more you and I can learn about change management principles the better our chances of financial success will become.

Hamels' first start since new deal a dud

ATLANTA (AP) - Ben Sheets, signed to a minor league contract nearly four weeks ago, was sharp. Cole Hamels, who signed a $144 million deal two days ago, had the worst control of his career.

Brian McCann hit a three-run homer off Hamels, and Sheets continued his impressive comeback to lead the Atlanta Braves past the Philadelphia Phillies 6-1 on Friday night.

Sheets (3-0) won his third straight start, allowing one run and six hits with one walk and four strikeouts in six innings.

After missing all of last season while recovering from elbow surgery, Sheets signed the minor league deal on July 1 and had his contract purchased by the Braves on July 15.

Asked if the month has been a blur, Sheets said "Man, I'm just riding it, riding the wave.

"I mean, I'm on a very good team and the guys are doing the heavy pulling. I'm just trying to put in a little two cents myself, trying to help us out."

The Braves trail first-place Washington, which lost to Milwaukee 6-0, by four games in the NL East.

McCann has eight homers and 19 RBIs in his last 15 games since July 5 and has lifted his batting average from .225 to .242.

"I like hitting right now," McCann said. "It's been a good couple of weeks, a good month I guess. I'm just glad I'm back to where I have been my whole career. My first half was brutal. I just put it behind me. To be honest I think that was the best thing that's ever happened to me. It made me get back to the basics and doing what I've always done. It was a wakeup call, it really was."

McCann has six home runs and 16 RBIs in six games against the Phillies this season, giving him 17 homers overall.

Hamels (11-5), making his first start since signing the six-year extension on Wednesday, set a career high with six walks in his shortest start of the season. He allowed five runs, three earned, on four hits with seven strikeouts in five innings.

He said he has been through a lot this week.

"It was a long week," Hamels said. "I don't think I'll have to experience that again."

Hamels said he was affected by "one of the more humid days I've ever had to pitch.

"It was one of the few games I've had to change my jersey twice," he said. "I'm hoping I don't have to do that ever again."

Hamels said the humidity affected his grip on the ball.

"I tried to force the issue over and over and over," he said. "Every pitch I could throw today was problematic."

The Braves weren't expecting six walks from Hamels.

"We got Cole on an off night," said Chipper Jones. "I don't know that I've ever seen him walk five or six guys in a game. Very uncharacteristic but we took advantage of it."

The loss ended Philadelphia's four-game winning streak and cost the Phillies a chance to move out of last place in the NL East.

Sheets did not allow a run while winning his first two starts in his comeback with Atlanta. That streak of 12 scoreless innings ended before he recorded an out against the Phillies.

Jimmy Rollins led off with a single and scored on Shane Victorino's double to the gap in right-center.

The Braves, helped by Hamels' control problems and a fielding error by third baseman Mike Fontenot, scored two unearned runs in the second. The inning could have been bigger, as Jones was picked off second base after his leadoff double.

Hamels walked Freddie Freeman, Dan Uggla and Paul Janish to load the bases with two outs. Sheets' grounder bounced under Fontenot's glove for an error, allowing Freeman to score. Michael Bourn's single to left field drove in Uggla, giving the Braves a 2-1 lead.

After Jason Heyward walked with one out in the fifth, Jones added his second double of the game. Hamels struck out Freeman before McCann's three-run homer, a high blast to center field, gave Atlanta a 5-1 lead.

John Mayberry Jr. dropped Bourn's fly ball in the left-field corner for a three-base error with two outs in the sixth. Martin Prado's single off Jeremy Horst pushed the lead to 6-1.

The Phillies loaded the bases against Jonny Venters in the seventh, but he struck out Ryan Howard to end the threat.

NOTES: Hamels' previous high was five walks, most recently on June 29, 2007, against the Mets. ... House drought bill keeps $5 billion subsidy targeted by reformers

WASHINGTON (Reuters) - Farmers would get another round of the $5 billion a year "direct payment" subsidy, targeted by reformers as wasteful spending, in a Republican-drawn offer of disaster aid for farmers hurt by the worst drought in half a century.

The package, unveiled on Friday, combines drought relief with a one-year extension of the farm program. If passed by the House next week and accepted by Senate, it would end a farm-bill stalemate by deferring work until 2013, when cost-cutting pressure may be intense.

An estimated $1.2 billion in drought relief would be provided under the bill, half to livestock producers and half to crop growers. While crop insurance will provide a safety net for many growers, livestock producers face parched pastures and rising feed costs.

The direct payment, paid to cotton, grain and soybean growers regardless of need, was marked for elimination in farm bills in the House and Senate this year. Budget hawks and environmentalists said the direct payment is wasted money, considering the farm sector enjoys boom times and the huge federal deficit.

An advocate for small farmers, the National Sustainable Agriculture Coalition, called for the House to "vote down this dirty extension bill." The bill would cut soil and water conservation programs while keeping the direct payment, it said.

Two-thirds of the continental United States is under moderate to exceptional drought and 40 percent of U.S. counties are listed as agricultural disaster areas. The worst drought conditions since 1956 fueled demands for Congress to act.

House Agriculture Committee chairman Frank Lucas said the package responded to "devastating drought conditions afflicting most of our country" and, by extending the 2008 farm law expiring on September 30, would end any doubts about the farm program for the new crop year.

Collin Peterson, the Democratic leader on the committee, said he opposed an extension unless it was a vehicle for a speedy compromise on a successor to the 2008 law that expires on Sept 30. There is virtually no way for Congress to meet that deadline without resorting to unusual parliamentary methods.

House Republican leaders are sitting on a $491 billion farm bill that was approved by Lucas' committee earlier this month because it faces strong opposition. Majority Leader Eric Cantor says the Senate-passed farm bill is unacceptable.

The Senate bill could save $23 billion over 10 years compared to $35 billion in the House bill. The House bill would raise crop support prices by up to 40 percent while the Senate would eliminate almost all traditional farm subsidies and, instead, compensate growers for low prices and poor yields.

Food stamps for the poor would be cut by $16 billion in the House farm bill, the largest cuts since the 1990s. Democrats want to eliminate the food stamp cuts while some Republicans want deeper cuts throughout the farm bill.

The disaster bill would revive disaster programs that share feed cost for livestock producers and compensate them for animals killed by drought as well as programs to assist fruit, vegetable, tree and fish farmers. The so-called SURE program for crop growers also would be extended.

On Thursday, Senate Agriculture Committee chairwoman Debbie Stabenow said she was ready to make a legislative sprint and complete a new, full-scale farm bill. "If Congress does what Congress always does and kicks the can down the road with a short-term extension, there will be no reform, direct payments will continue, we'll lose the opportunity for major deficit reduction and we'll deliver a real blow to our economic recovery," said Stabenow.

(AP) ? Supreme Court Justice Antonin Scalia is downplaying reports of discord among the justices following last month's decision to uphold President Barack Obama's health care overhaul.

Scalia said in an interview with The Associated Press on Thursday that he and his colleagues disagree over cases all the time "without taking it personally."

The 76-year-old justice refused to discuss reports from CBS News that Chief Justice John Roberts changed his vote in the health care case and provoked hard feelings among his fellow conservatives who thought Roberts would side with them to strike down the law.

Scalia is giving a round of media interviews to promote the new book "Reading Law: The Interpretation of Legal Texts" that he co-authored with Bryan Garner.

U.S. growth offsets Europe's woes for some industrials

BOSTON (Reuters) - Some U.S. manufacturers shook off weak European demand in the latest quarter, with makers of products ranging from bulldozers to cars finding solid demand at home was enough to offset weakness abroad.

Caterpillar Inc , Ford Motor Co , Boeing Co and Rockwell Automation Inc reported earnings that topped Wall Street's expectations.

Caterpillar and Boeing raised their forecasts for the rest of the year, while Ford and Rockwell cut theirs, in part due to Europe's ongoing financial crisis.

Wednesday's earnings reports were less grim than a day earlier when United Parcel Service Inc , printer maker Lexmark International Inc and phone company AT&T Inc warned that belt-tightening by their corporate customers was taking a toll on results.

"The U.S. has a few positive things going for it. There's a stronger currency, which will draw in investment, the housing sector is slowly repairing itself and commercial construction is still very tepid but that's not going to get worse and could become a positive," said Peter Klein, senior portfolio manager at Fifth Third Asset Management in Cleveland, Ohio.

"I don't think we're looking at a recession or a recessionary environment (in the United States), we're just looking at a really slow period," he said.

Sixty-five percent of the 195 companies in the Standard & Poor's 500 index <.spx><.inx> that have reported earnings so far this quarter have topped Wall Street estimates, with earnings on average up 13.6 percent, according to Thomson Reuters I/B/E/S. But the majority -- 59 percent -- have missed revenue forecasts, with mean revenue up just 3.9 percent.

EVEN THE STRONG ARE WARY

Even at companies that had managed their way around Europe, that economic crisis remained foremost in executives' minds.

"We understand the world is facing economic challenges, and if it becomes necessary, we are prepared to act quickly as we did in late 2008 and 2009," said Caterpillar Chief Executive Doug Oberhelman.

The world's largest maker of earth-moving equipment slashed about 20,000 jobs in 2009, in the wake of the financial crisis.

"While we're prepared, the good news is, this doesn't feel like 2008," Oberhelman said. "Interest rates are low, central banks are prepared to inject more liquidity if needed, and housing is coming off lows, not a peak, and seems to be improving."

Caterpillar's results benefited from strong demand from Asian and North American mining sectors. North American equipment sales rose 34 percent in the quarter, while sales in the Asia-Pacific region were up 25 percent.

Demand for mining equipment also lifted Rockwell Automation in the quarter. CEO Keith Nosbusch said that reflected the fact that mining equipment is a less-discretionary purchase for a corporate customer than office gear such as printers and phones.

"Mining tends to be a tough application where the equipment wears out," Nosbusch said. "If your mines are running and producing -- and because of the commodity prices they are -- you tend to have to maintain them and part of that means replacement equipment."

No. 2 U.S. automaker Ford beat analysts' expectations in the second quarter but warned investors it now expects operating profit to decline for the year due to mounting losses in Europe.

"As we look over the next five years and lay out all of our plans for our business, we just think the situation in Europe is going to be challenging," Chief Financial Officer Bob Shanks told reporters at Ford's headquarters.

Boeing, which reported better-than-expected 3 percent earnings growth and is on track to overtake European rival Airbus as the world's largest plane maker, tried to restrain Wall Street's enthusiasm.

CEO Jim McNerney warned in a slide presentation for analysts that "global economic growth continues at a slow pace (and) uncertainties remain."

Caterpillar shares were up 0.9 percent at $82.13 on Wednesday afternoon, while Ford stock was down 0.9 percent at $8.98. Boeing shares were up 2.8 percent at $74.04. All three trade on the New York Stock Exchange.

Companies reporting results on Wednesday generally saw solid revenue growth in North America, for two reasons: demand was higher and the value of their sales in Europe was reduced by the slump in the euro currency versus the dollar.

Rockwell Automation, a maker of equipment that runs factories and other industrial processes, saw its fastest sales growth in Canada, where demand from miners helped drive sales up 19 percent. Sales in the United States -- its largest market -- rose 6 percent, and revenue fell 6 percent in Europe, the Middle East and Africa, as well as Latin America.

It reported third fiscal-quarter profit that topped Wall Street's expectations, but cut its forecast for the rest of the year, sending shares down 1.7 percent to $64.05 on Wednesday afternoon.

TE Connectivity , the former Tyco Electronics, also reported relatively stronger results in the Americas -- where its sales were up 1 percent -- versus Europe, the Middle East and Africa, where they fell 8 percent.

The maker of electronic connectors said it expected a further slowing in Europe in the current quarter, partly because of production shutdowns among auto manufacturers.
